1. Acceptance of Terms
These Terms govern your access to and use of the DeepGoon website, platform, and all related services (collectively, the "Platform"), operated by Chromegreen Media Limited, a company registered in Alberta, Canada ("we," "us," or "our"). By creating an account, uploading content, or otherwise accessing the Platform, you agree to these Terms and our Privacy Policy, which is incorporated herein by reference.
We reserve the right to update these Terms at any time. We will notify users of material changes by updating the "Effective Date" above. Continued use of the Platform after changes constitutes acceptance of the revised Terms.
2. Age Requirement — 18+ Only
You must be at least 18 years of age to access or use this Platform. This Platform contains sexually explicit content intended solely for adults. By accessing the Platform, you represent and warrant that:
- You are at least 18 years of age (or the age of majority in your jurisdiction, if higher);
- Accessing adult content is legal in your jurisdiction;
- You are not accessing the Platform from a location where such content is prohibited;
- You will not permit any minor to access your account or view content on this Platform.
We reserve the right to terminate any account we have reason to believe belongs to a minor, without notice or refund.
3. Account Registration
To access certain features, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration;
- Maintain the security of your password and not share your credentials;
- Notify us immediately of any unauthorized access to your account at deepgoonsupport@gmail.com;
- Be responsible for all activity that occurs under your account;
- Not create more than one account without our express written permission;
- Not create an account if you have previously been banned from the Platform.
We reserve the right to suspend or terminate accounts at our discretion, including for violation of these Terms, without prior notice.
4. Acceptable Use
4.1 Permitted Use
You may use the Platform to:
- Browse and view content;
- Upload original AI-generated VR and 2D video content you have the rights to share;
- Create and interact with AI companion characters;
- Subscribe to premium tiers;
- Interact with other users through comments.
4.2 Prohibited Content
You may NOT upload, share, generate, request, or promote any content that:
- Depicts, suggests, or sexualizes minors in any form — whether real, fictional, animated, drawn, or AI-generated, and including any character depicted as, appearing to be, or presented as being under 18 years of age (regardless of any stated or claimed age). This is an absolute prohibition with zero tolerance. Under Canadian law (Criminal Code s. 163.1), fictional and AI-generated depictions of minors are criminal — no real child needs to be involved. Violations result in immediate account termination and reporting to the appropriate authorities, including the Canadian Centre for Child Protection (Cybertip.ca), NCMEC, and law enforcement;
- Depicts, resembles, or identifies any real person — including AI-generated or AI-altered imagery resembling celebrities, public figures, or private individuals ("deepfakes"). This is an absolute prohibition: real-person likeness is not permitted under any circumstances, including with that person's consent. A person is "identifiable" if a reasonable observer could recognize them from the content, its title, tags, or description;
- Is real (non-AI-generated) pornographic content depicting actual human beings — this Platform hosts AI-generated content exclusively;
- Depicts rape, sexual coercion, or sexual activity with persons who are unconscious, asleep, drugged, intoxicated, or otherwise incapable of consent;
- Depicts bestiality, necrophilia, or incest;
- Depicts urine in a sexual context ("watersports" / golden showers / urolagnia), or feces or defecation in a sexual context ("scat" / coprophilia);
- Solicits, offers, advertises, arranges, or otherwise facilitates real-world prostitution, escorting, or sex-for-money services — including using the Platform's chat to arrange or direct users toward such services — or any form of sex trafficking;
- Constitutes harassment, hate speech, or targeted abuse of real individuals;
- Infringes the copyright, trademark, or other intellectual property rights of any third party;
- Contains malware, viruses, or malicious code;
- Violates any applicable local, state, national, or international law or regulation;
- Is designed to deceive or defraud other users.
These prohibitions apply to all content on the Platform in any form — uploaded videos and images, thumbnails, titles, tags, descriptions, comments, AI companion conversations, and content produced by the Platform's AI image and chat generation features. Attempting to prompt the Platform's AI tools to produce prohibited content is itself a violation of these Terms.
4.3 Prohibited Conduct
You may NOT:
- Attempt to reverse-engineer, scrape, or harvest data from the Platform without permission;
- Use automated scripts or bots to interact with the Platform;
- Attempt to gain unauthorized access to other users' accounts or our systems;
- Circumvent or disable any age verification, content filtering, or security features;
- Impersonate another person, user, or DeepGoon staff;
- Use the Platform to distribute spam or unsolicited communications.
5. User-Generated Content & License
5.1 Your Content
You retain ownership of the original elements of content you upload ("Your Content"). By uploading content to the Platform, you grant DeepGoon a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, transcode, display, distribute, and otherwise use Your Content solely for the purpose of operating and providing the Platform.
5.2 Your Representations
By uploading content, you represent and warrant that:
- You own or have all necessary rights, licenses, and permissions to upload and share the content;
- The content does not infringe any third-party intellectual property rights;
- The content is entirely AI-generated and does not depict any actual human being;
- The content does not depict, resemble, or identify any real person — by likeness, name, title, tag, or description — under any circumstances, including with that person's consent;
- No minors — real, fictional, animated, or AI-generated — are depicted or suggested in any content, and all characters depicted are presented as adults aged 18 or older;
- The content complies with all applicable laws and these Terms, including the laws of Canada.
5.3 AI-Generated Content
Content generated using AI tools (including AI image and video generation features on this Platform) is subject to the following:
- You are responsible for ensuring that prompts and outputs comply with these Terms and applicable law;
- AI-generated content may be subject to evolving legal frameworks regarding intellectual property — you assume all risk related to IP ownership of AI-generated outputs;
- You may not use AI generation features to produce content that violates Section 4.2.
5.4 Content Moderation, Removal & Appeals
Pre-publication review: Uploaded content is held in a moderation queue and reviewed before it becomes publicly visible on the Platform. We may approve, reject, or request changes to any submission at our sole discretion.
Removal: We reserve the right to remove any content at any time, at our sole discretion, that we determine violates these Terms, applicable law, or is otherwise objectionable, without prior notice or liability to you.
Complaints: Any person may report content they believe violates these Terms or the law by emailing deepgoonsupport@gmail.com with the subject line Content Complaint and a link to the content. We review all complaints and aim to resolve them within seven (7) days.
Appeals: If your content is rejected or removed and you believe this was in error, you may appeal within 30 days by emailing deepgoonsupport@gmail.com with the subject line Content Appeal, identifying the content and explaining why it complies with these Terms. Appeal decisions are final. Content removed for child sexual abuse material or non-consensual intimate imagery is not eligible for appeal.
6. DMCA & Copyright
DeepGoon respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512. If you believe content on the Platform infringes your copyright, please send a DMCA takedown notice to our designated agent at:

Your notice must include:
- Identification of the copyrighted work claimed to have been infringed;
- Identification of the infringing material and its location on our Platform;
- Your contact information (name, address, email, phone);
- A statement that you have a good faith belief the use is not authorized;
- A statement that the information in your notice is accurate, under penalty of perjury;
- Your physical or electronic signature.
Users who repeatedly infringe copyrights will have their accounts terminated.
7. Non-Consensual Intimate Imagery (NCII) Removal
DeepGoon strictly prohibits intimate imagery — including AI-generated or AI-altered imagery ("deepfakes") — depicting any identifiable person without their consent. This section implements our obligations under the U.S. TAKE IT DOWN Act and applicable Canadian law, including Criminal Code s. 162.1 and provincial intimate-images legislation.
If you are depicted: If you believe content on this Platform depicts you (or someone you are authorized to act for) in an intimate or sexual manner without consent — whether the content is authentic or AI-generated — submit a removal request to:

Your request should include:
- A link to (or identification of) the content on our Platform;
- A statement that the content depicts you (or the person you represent) and was published without consent;
- Information reasonably sufficient for us to verify your identity or your authority to act for the depicted person;
- Your contact information.
We will remove validly reported NCII within 48 hours of receiving the request, and will make reasonable efforts to remove identical copies of the same content. Submitting an NCII removal request does not require a copyright claim, court order, or police report. We will not retaliate against good-faith requesters, and we may terminate the accounts of users who upload NCII.
8. Subscriptions & Payments
8.1 Free & Premium Tiers
The Platform offers both a free tier and paid premium subscription tiers. Premium features are described on the subscription page and may change over time.
8.2 Billing
Premium subscriptions are billed on a recurring basis (monthly or annually, as selected). By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel. All prices are in USD unless otherwise stated.
8.3 Cancellation & Refunds
You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period — you will retain access to premium features until then. We do not provide refunds for partial billing periods, except where required by applicable law.
8.4 Virtual Currency (Apples)
The Platform may use virtual currency ("Apples") for certain in-platform features. Apples have no real-world monetary value, are non-transferable, non-refundable, and may expire or be removed at our discretion.
9. Privacy
Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it carefully.
10. Disclaimers
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components. We do not guarantee the accuracy, completeness, or usefulness of any content on the Platform.
AI Companions: AI companion characters are fictional and for entertainment purposes only. They are not real people. Any emotional attachment, relationship, or reliance placed on AI companions is entirely at your own risk. We are not liable for any psychological harm arising from your use of AI companion features.
VR Content: Extended use of VR content may cause discomfort, motion sickness, or disorientation. Use VR features responsibly and take breaks as needed. We are not liable for physical discomfort or injury arising from VR use.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DEEPGOON AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE PLATFORM SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100 USD.
12. Indemnification
You agree to indemnify, defend, and hold harmless DeepGoon and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of the Platform; (b) Your Content; (c) your violation of these Terms; or (d) your violation of any third-party rights.
13. 18 U.S.C. § 2257 Compliance Statement
DeepGoon is a platform exclusively for AI-generated content. Content depicting actual human beings is prohibited by Section 4.2 of these Terms, and all visual depictions on this Platform are required to be computer-generated artificial imagery that does not depict any actual human being. Accordingly, the records-keeping requirements of 18 U.S.C. § 2257 and 28 C.F.R. Part 75 do not apply to content on this Platform.
If any content is discovered to depict an actual human being, it will be removed immediately, the uploading account will be terminated, and — where the content is intimate imagery of an identifiable person — it will be handled under our NCII removal process (Section 7) and reported to authorities where required by law. Uploaders warrant under Section 5.2 that their content depicts no actual persons; any uploader who breaches this warranty bears sole responsibility for all records required by 18 U.S.C. § 2257 with respect to that content.
14. Termination
We may suspend or terminate your account and access to the Platform at any time, for any reason or no reason, with or without notice, including for violation of these Terms. Upon termination:
- Your right to use the Platform immediately ceases;
- We may (but are not obligated to) delete your account data and content;
- Provisions of these Terms that by their nature should survive termination shall survive, including Sections 5, 6, 7, 11, 12, 13, and 15.
15. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict of law provisions.
Any dispute arising out of or relating to these Terms or the Platform shall first be attempted to be resolved through good-faith negotiation between the parties. If unresolved within 30 days, disputes shall be submitted to binding arbitration in Calgary, Alberta in accordance with the Arbitration Act (Alberta). You waive any right to a jury trial or to participate in a class action proceeding.
Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction in Alberta.
16. Miscellaneous
- Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and DeepGoon regarding the Platform.
- Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
- Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right.
- Assignment: You may not assign your rights or obligations under these Terms. We may assign ours without restriction.
- No Third-Party Beneficiaries: These Terms do not create any third-party beneficiary rights.
